Indiana: New Leave of Absence Law for School Activities Established

Indiana has passed a new law allowing employees unpaid time away from work to attend certain school-related activities. Effective July 1, 2025, employers — including state agencies and political subdivisions — may not take adverse employment action when the employee attends either an attendance conference or a case conference committee meeting for the employee’s child. Under this law, "child" includes a biological child, adopted child, foster child or stepchild.

Employee absences are restricted to attendance at a single conference or meeting per year, and the duration of the absence cannot exceed the time reasonably required for travel and participation at the conference or meeting. Employees are required to provide their employer with at least five days of advance notice prior to attendance and documentation that they attended the conference or meeting. Employees are also required to make a reasonable effort to schedule these activities as virtual conferences or meetings.
